Draft for legal review. These terms have not yet been reviewed by an attorney and may change.
1. 90-day limited warranty
Cargo Clamp LLC ("Cargo Clamp," "we," "us") warrants to the original retail purchaser that Cargo Clamp clamps, rail spines and end caps will be free from defects in materials and workmanship for ninety (90) days from the date of purchase when installed and used according to our printed and online instructions. If a covered defect appears during the warranty period, we will, at our option, replace the defective part or refund its purchase price. Replacement or refund is your sole and exclusive remedy under this warranty.
2. What the warranty does not cover
This warranty does not cover damage or failure caused by:
- use on the outside of any vehicle, boat, RV, side-by-side, ATV, trailer or other transportation device;
- using a single-latch clamp to hold items in transit (a double-latch clamp is required for items in transit, and only inside a truck bed or cargo area);
- loads over 50 lb per clamp;
- forcing an item into a clamp of the wrong size, or forcing or prying a latch;
- heat, including engines, exhaust, heaters, direct flame or other high-heat sources;
- improper mounting, including mounting to drywall alone, mounting the 10″ rail other than horizontally or the 4″ rail other than vertically;
- accident, abuse, alteration, modification, or normal wear and tear;
- use with people or animals, or for climbing, lifting or fall protection.
3. How to make a warranty claim
Email support@cargoclamp.com within the warranty period. Include your order number, a short description of the problem and a photo of the part and how it was mounted. We may ask you to return the part before a replacement or refund is issued.
4. Proper use
You are responsible for selecting the correct clamp size, mounting the rail securely into a stud or a 1×4 board at minimum, using the double latch for any item in transit, staying within the 50 lb per clamp limit, inspecting your clamps and screws regularly, and stopping use of any part that is cracked or does not latch securely. Read the instructions on the How it works and Safety sections before use.
5. Assumption of risk
You understand that storing and transporting tools and equipment involves risk. By installing or using a Cargo Clamp product, you assume all risks of property damage, personal injury or other loss arising from improper use, misuse, improper installation, or failure to follow our instructions and warnings.
6. Limitation of liability
To the fullest extent permitted by law, Cargo Clamp LLC is not responsible or liable for any property damage, vehicle damage, personal injury, loss of use, or any other damages of any kind, whether direct, indirect, incidental, special or consequential, resulting from improper use, misuse, improper installation, exterior vehicle use, overloading, modification, or failure to follow Cargo Clamp instructions and warnings. Except for the limited warranty above, Cargo Clamp products are provided "as is," and Cargo Clamp disclaims all other warranties, express or implied, including any implied warranties of merchantability and fitness for a particular purpose, to the extent permitted by law. In no event will Cargo Clamp's total liability exceed the amount you paid for the product that gave rise to the claim.
7. Indemnification
You agree to defend, indemnify and hold harmless Cargo Clamp LLC and its owners, officers, employees and agents from and against any claims, demands, losses, damages, costs and expenses (including reasonable attorneys' fees) brought by you or any third party arising out of or related to your misuse or improper use of any Cargo Clamp product, improper installation, exterior vehicle use, or your failure to follow Cargo Clamp instructions and warnings.
8. General terms
Some states do not allow the exclusion or limitation of incidental or consequential damages or limits on how long an implied warranty lasts, so some of the limits above may not apply to you. This warranty gives you specific legal rights, and you may have other rights that vary from state to state. These terms are governed by the laws of the State of Colorado.
